Have you thought about how The Economic Crime and Corporate Transparency Act 2023 impacts your organisation?

Alice Boulton, Illicit Finance Lead, National Economic Crime Centre (NECC), National Crime Agency (NCA) will be at our conference to share her great work regarding the Economic Crime and Corporate Transparency Act (ECCTA) 2023. Alice leads on the NECC’s work on the ECCTA and has been working closely with Companies House.

The ECCTA is an Act which makes further provision about economic crime and companies, limited partnerships and other kinds of corporate entity. Some of the significant changes brought about by the company increase the powers of Companies House and some key provisions include:

Identification doctrine: How companies are prosecuted has also changed. We can now simply identify the ‘senior managers’ instead of identifying the person(s) “directing mind and will” of a company prosecute it for committing an offence. This significantly broadens the scope to attribute criminal liability to a company.
 

Failure to prevent fraud: The introduction of a failure to prevent fraud offence holds all large businesses to account if they profit from fraud committed by their employees. Are you aware that a business can be prosecuted under this offence? Does your organisation have “reasonable” procedures in place to prevent fraud? Make sure to attend Alice’s session to learn more.
